1. Legal position

Earnnest is not an investment adviser (CIF). Earnnest is a decision-support tool based on algorithms. It holds no authorisation from the Autorité des marchés financiers (AMF) and provides no personalised investment advice within the meaning of Article L.321-1 of the French Monetary and Financial Code or Article 4(1)(4) of the MiFID II Directive.

Earnnest is neither an investment services provider (PSI), nor an investment adviser (CIF), nor a crypto-asset service provider (CASP). It is not subject to authorisation under:

  • Article L.321-1 of the CMF: investment services providers
  • Article L.541-1 of the CMF: investment advisers
  • MiFID II, Article 4(1)(4): investment advice (EU)
  • Regulation (EU) 2023/1114 (MiCA): crypto-asset service providers

Earnnest positions itself as an analysis and visualisation tool that provides algorithmic signals based on public market data, without taking into account the user's personal, wealth or tax situation.

2. Algorithmic signals: definition and limits

The terms “bullish signal”, “bearish signal” and “neutral signal” refer to results of technical algorithms (RSI, MACD, Bollinger, ADX indicators, sentiment analysis, machine learning models…). These signals:

  • are calculated from historical price and volume data;
  • do not take into account the user's personal situation (investment horizon, risk tolerance, tax situation, wealth…);
  • are not a recommendation to buy, hold or sell financial instruments in the regulatory sense;
  • may be wrong or incomplete and must not be used as the sole decision criterion.

The user remains solely responsible for their investment decisions and, before any transaction, should consult an authorised professional if necessary.

3. Risk warning

Investing on the stock market carries a risk of capital loss, partial or total. Past performance is no guarantee of future performance, in accordance with Article 36 of Delegated Regulation (EU) 2017/565 (MiFID II). The historical results shown in Earnnest (signal tracking, simulations) are provided for illustration and guarantee no future result.

Financial markets are exposed to market, liquidity, currency and counterparty risks and to unforeseeable events (geopolitical risk, systemic crisis…).

4. Crypto-assets and the MiCA Regulation

Earnnest offers technical signals on certain crypto-assets (Bitcoin, Ethereum…). These signals are provided for information only. Earnnest is not registered as a crypto-asset service provider (CASP) within the meaning of Regulation (EU) 2023/1114 (MiCA), in force since December 2024.

Crypto-assets carry high specific risks: extreme volatility, no deposit guarantee, risk of total loss, an evolving regulatory framework. They are not suitable for all investors.

5. No personalisation

Earnnest does not ask for an investor profile and does not adapt any signal to the user's situation: the analysis method is the same for all users. Only the list of securities analysed varies, and it includes those the user has chosen to follow.

Earnnest calculates no tax and establishes no tax base. The positions you enter, import or read from a connected broker are used only to analyse your portfolio.

6. Data sources and conflicts of interest

Earnnest relies on publicly available market data and on quantitative analysis models to provide its diagnostics.

Earnnest receives no remuneration from the issuers of the financial instruments analysed. There is no commercial conflict of interest with the companies whose securities are analysed.

Earnnest may receive affiliation or referral commissions from partner brokerage platforms. These commercial relationships do not influence the algorithmic signals.

7. Scope of the service

Earnnest provides no personalised investment advice and will not do so without the required authorisation. Broker connections are read-only: Earnnest cannot place, modify or cancel any order and holds no funds.
