1. Preamble
These Terms of Sale govern access to the paid plans of the online service Earnnest, available at goearnnest.com and published by EI MARQUIS BUREAU David (sole proprietorship, SIREN 109 426 387), whose address is 5 rue Augustin Fresnel, 85600 Montaigu-Vendée.
Using the paid plans implies acceptance of these Terms. The publisher may amend them; the version that applies to a subscription is the one accepted when it was taken out.
The service is reserved for adults (18 or over) acting for non-professional purposes and living in the European Economic Area (EEA). By subscribing, you declare that you meet these conditions. A subscription taken out with a billing address outside the EEA is cancelled and refunded in full.

2. Description of the service
Earnnest is a financial analysis tool available by subscription. It provides automated technical signals, fundamental analyses, a screener, portfolio tracking and other decision-support features.
Earnnest is not an investment advice service within the meaning of Directive 2014/65/EU (MiFID II). See the Legal notice.

Prices are in euros, including all taxes (incl. VAT). **VAT not applicable, Article 293 B of the French General Tax Code**: the publisher benefits from the VAT basic exemption scheme, so the price shown is the price paid, with no VAT added. The annual plan is billed once, for twelve months.
If the publisher ceased to benefit from the VAT basic exemption scheme, it would inform subscribers and the applicable VAT would be shown on invoices; any price change would follow the procedure below.
Prices may change. Subscribers are notified by e-mail 30 days before any price change and may cancel before it takes effect.
4. Seller, order and payment
Paid plans are sold under a contract between the publisher and the subscriber. Payments are processed by **Stripe**, a payment provider, which collects the price on the publisher's behalf. An invoice in the publisher's name is issued for each payment and sent by e-mail.
Payment is made online by bank card. It is charged when you subscribe, then renewed automatically at each monthly or annual due date. The order is confirmed by e-mail to the account address.
Subscribing is an order with an obligation to pay.
Payment data is processed by Stripe. Earnnest does not store any card data.
5. Right of withdrawal: 14 days
In accordance with Articles L. 221-18 et seq. of the French Consumer Code and Directive 2011/83/EU, you have 14 calendar days from subscribing to withdraw, without giving any reason and without penalty.
How to withdraw. During this period, use the “Withdraw from contract here” function on the Pricing page: it works in two steps (request, then confirmation), cancels the subscription immediately and sends you an acknowledgement of receipt by e-mail. You can also write to support@goearnnest.com with “Withdrawal” as the subject, stating your account e-mail address and the subscription date.
Withdrawal form (template):
To the publisher Earnnest (support@goearnnest.com): I hereby notify you of my withdrawal from the contract for the Earnnest [plan] subscription taken out on [date], for the account [e-mail].
Immediate performance. When subscribing, you expressly ask for the service to start before the end of the withdrawal period. If you then withdraw, you pay an amount proportionate to what has been provided up to the moment of withdrawal (Article L. 221-25 of the French Consumer Code).
Refund. It is made no later than 14 days after your withdrawal, to the payment method used, minus the part of the service already provided.
6. Renewal and cancellation
The subscription renews automatically at the end of each period. A reminder e-mail is sent 7 days before each renewal. For an annual subscription, an information e-mail is also sent between two months and one month before the due date (Article L. 215-1 of the French Consumer Code).
You can cancel at any time from the Pricing page (“Manage my subscription”). Cancellation takes effect at the end of the current period; no pro rata refund is due for the remaining days, apart from the right of withdrawal.
7. Access to the service and availability
The service is available 24/7, subject to planned maintenance (announced in advance) and events beyond the publisher's control (force majeure, supplier outage). The publisher commits to a target availability of 95%.
In the event of unavailability exceeding 72 consecutive hours, the subscriber may request a credit proportional to the duration of the interruption.
8. Purpose of the service and liability
What the publisher commits to. Earnnest gives access to indicators, scores and analyses calculated automatically from public market data. The publisher applies to this processing, and to the availability of the service under Article 7, the care and diligence of a professional.
What is outside the scope of the service. The service includes no investment advice within the meaning of Directive 2014/65/EU (Article L. 321-1 of the French Monetary and Financial Code in France), no personalised recommendation, no portfolio management and no reception or transmission of orders: the publisher holds no authorisation to provide these services and does not offer them. Nor does the publisher's commitment cover the accuracy of data supplied by third-party providers or the achievement of any financial result: investment decisions are made by the subscriber alone, outside the service. Any investment carries a risk of capital loss.
Liability. The publisher is liable under ordinary law for breaches of its own obligations as defined above. Nothing in these terms removes or reduces the consumer subscriber's right to compensation, or the statutory guarantees they enjoy, in particular the statutory guarantee of conformity applicable to digital content and services.
9. Fair use of unlimited plans
Plans presented as including an unlimited number of analyses are intended for individual use. Beyond 200 analyses per calendar month, the publisher may lengthen the refresh window of the subscriber's analyses to that of the free plan, i.e. 8 hours instead of 30 minutes or 2 hours depending on the plan.
This measure does not suspend access to the service, refuses no analysis and gives rise to no additional charge: only the data consulted may be less recent. It ends automatically on the first day of the following month. The subscriber can check their usage at any time from their account area.
10. Intellectual property
All the elements making up the service (code, design, texts, the Ernest mascot) are protected by intellectual property law. Any reproduction, even partial, is prohibited without prior written authorisation.
11. Governing law and disputes
These Terms are governed by French law. If you live in another country, you keep the benefit of the mandatory consumer protection rules of your country of residence and may bring proceedings before the courts of that country.
In the event of a dispute, an amicable solution will be sought first (contact: support@goearnnest.com).
Consumer mediation
In accordance with Articles L. 616-1 and R. 616-1 of the French Consumer Code, if an amicable complaint fails, the consumer may refer the matter free of charge to the designated mediator:
