1. Purpose
These Terms of Use set the rules for accessing and using the Earnnest service, available at goearnnest.com. Accessing the service, even free of charge, implies acceptance of these Terms.
These Terms supplement the Terms of Sale, which apply to the paid plans.
2. Conditions of access
Earnnest is reserved for adults (minimum age: 18) who have legal capacity to commit in a personal capacity and who live in the European Economic Area.
Access is through a Google account (OAuth 2.0). Users are responsible for keeping their credentials confidential and for any activity carried out from their account.
3. Rules of use
Users undertake to use the service lawfully and not to:
- Resell, redistribute or make available the signals, scores, analyses or any other content generated by Earnnest to third parties, whether for payment or free of charge, without the publisher's prior written agreement.
- Use the data for paid investment advice to third parties, or within a regulated financial service, without the required authorisations.
- Access the service automatically (scraping, bots, crawlers) or try to get around quota or rate limits.
- Copy, decompile or extract the source code, algorithms or database without authorisation.
- Introduce malicious data, try to exploit flaws or disrupt the service for other users.
Any breach may lead to immediate suspension or termination of the account, without prejudice to any legal action.
4. Nature of the service: a decision-support tool, not financial advice
Earnnest is a technical and fundamental analysis support tool. The signals, scores and analyses, including those generated by artificial intelligence, are produced automatically from public data. They are in no way:
- investment advice within the meaning of the MiFID II Directive (2014/65/EU) (Article L.321-1 of the French Monetary and Financial Code in France);
- personalised recommendations to buy or sell financial instruments within the meaning of Article 4(1)(4) of MiFID II;
- investment research in the regulatory sense (Article 36 of Delegated Regulation (EU) 2017/565).
Earnnest holds no authorisation as an investment adviser, investment firm or crypto-asset service provider. The indicators shown (bullish, neutral, bearish signal) are automated statistical aggregates. They do not take your personal financial situation into account. Users remain solely responsible for their investment decisions.
5. Limits of the service and verification by the user
Part of the analyses and summaries offered by Earnnest is generated by language models (AI). These models may produce incorrect, incomplete or outdated information, a phenomenon commonly called “hallucination”. Users must systematically check important information against primary sources (official reports, regulators, authorised brokers).
The publisher undertakes to bring to the design and operation of this processing the care and diligence of a professional. However, the following are outside the scope of the service: the accuracy of statements produced by the models, the accuracy of market data supplied by third-party providers, and the achievement of any financial result. Users keep full control of their investment decisions, which they make outside the service.
6. Data quality
The market data displayed (prices, fundamentals, news) comes from third-party sources and may be delayed by 15 minutes or more, incomplete or contain errors. Earnnest guarantees neither its accuracy nor real-time updating.
Data from some third-party sources may be unavailable because of usage limits: the service then degrades without interruption.
7. Intellectual property
All elements of the service (source code, design, texts, scoring algorithms, the Ernest mascot, logo) are protected by intellectual property law and remain the exclusive property of the publisher.
Users receive a personal, non-exclusive, non-transferable right to use the service, limited to strictly private use. Any reproduction, even partial, is prohibited without prior written authorisation.
8. Suspension and termination of an account
The publisher may suspend or terminate access to the service, without notice, in the event of:
- breach of these Terms;
- fraudulent or abusive use of the service;
- non-payment of the subscription;
- attempts to get around security measures.
Users can delete their account at any time from Settings → Account & data. Consumer rights (in particular the right of withdrawal and the refunds provided for in the Terms of Sale) are not affected.
9. Changes to these Terms
The publisher may amend these Terms. In the event of a substantial change, users are informed by e-mail at least 30 days before it takes effect. Continued use of the service after that date implies acceptance of the new Terms.
10. Governing law
These Terms are governed by French law. Any dispute is first subject to an attempt at amicable resolution. If you live in another country, you keep the benefit of the mandatory consumer protection rules of your country of residence.
